A. GENERAL
Below is a short overview of the rules of the usage of the material on this site.
I. ON BRALEY'S WORKS
1) BEFORE 1923
Of all Braley's works published before 1923, any work that is older than 75 years belongs in the public domain and can be copied without permission from the author or another copyright holder till then.
2) BETWEEN 1923 AND 1966
Of all Braley's works published between 1923 and his death in 1966, any work that is older than 95 years belongs in the public domain and can be copied without permission from the author or another copyright holder till then. So parts of this body of work start to be in public domain in 2018!
For the moment I have an oral agreement to present requests for publication from this copyrighted period to the present owners of those copyrights, the children of Ian Braley. So I'll pass on any request that is made.
3) ERRORS
I respect the copyrights that are not yet in the public domain. I sometimes do make mistakes however, and I welcome it if you point out that a copyright is still applicable and permission is required. Correction will be immediate.
4) PENDING PERMISSION REQUESTS WITH PUBLISHGERS
Meanwhile I still have quite a few outstanding requests for permission to publish with the original publishers. As soon as they get honored you may see more work by Berton Braley on this site.
II. ON MUSEUM'S MATERIALS
1) COURTESY MENTION
Even though most of this material is in the public domain, it is nevertheless good courtesy to mention the source if one wants to publish such material. It is an incentive for the source (in this case, me) to continue to provide easy access to otherwise unrecoverable or difficult to retrieve writings.
So please mention this web site address http://www.bertonbraley.com as your source, if you find something here that you want to publish elsewhere.
2) NOT ALLOWED
I do not allow the copying of the images and the HTML code and the design and structure of this site. It is anyway more practical to make a link to this site to ensure that your pages are maintained and that you do not end up, for example, with dead links. Please let me know if you want to link to my site and I'll also gladly keep you up to date on any changes. If you have a worthwhile site that fits the philosophy embedded in Berton Braley's work, then I'll also honor any request to reciprocate links.
Fundamentally this means, that creative content that applauds rational human endeavors is welcome, supporting the creation of anti-man activities (like anti-heroism, nihilism, subjectivism, skepticism, expressionism, etc) is not.
III. ON THIRD PARTY'S MATERIALS
I do not allow the copying of anything (text, pictures, sound) that has been posted on this site with the permission of another party who owns the copyright. However, I'll be glad to refer you to the copyright owner(s) if you want permission to use those items.

The 'before 1923' works are now in the public domain since they were not renewed. Please be aware that they may contain poems or stories where the copyright lays not with Berton Braley, but with a publisher and this publisher may have retained the copyright of a specific poem or story in a book. This usually happens when the work had already been published earlier in a magazine or newspaper.

The news syndicate NEA still exists and it is part of Multi Media which is again part of Scripps Howard.
At this moment I'm researching in how far they still retained any copyrights.
- All magazine and newspaper publications by Berton Braley published by Street & Smith:
Status: Unclear
- All works by Berton Braley published by Linda Tania Abrams through publisher The Atlantean Press:
Status: Limited copyright only.
The now defunct small publisher 'The Atlantean Press' published a small collection of Berton Braley's poems under the title "Virtues in Verse" where the copyrights rest with Linda Tania Abrams who assembled the poems. It is unclear if any applicable copyrights were retained or passed on to a new owner.
There is a recent copyright registration from 1993.
The copyright is only for the exact reproduction of her entire publication or of parts that are unique to it, but not for each individual Braley poem that she reproduced.
III. MUSIC SHEETS
- All music sheet publications by Berton Braley published by G. Schirmer:
Status: Unclear if any copyrights have been extended.
Schirmer still exists so it is wise to ask permission for publication of anything published in 1923 or later that is younger than 95 years at G. Schirmer, Inc.'s web site
- All music sheet publications owned by Berton Braley himself
Status: PUBLIC DOMAIN: if published before 1923
COPYRIGHTED: if published between 1923 and 1966. Copyright retained by the children of Ian Braley (son of Berton Braley).
IV. UNPUBLISHED WORKS
- All unpublished works by Berton Braley which were kept by his son Ian Braley:
Status: Copyright retained by the children of Ian Braley.
There may be some works by Braley that were never published and that were in the possession of his son Ian Braley. Since Ian passed away on October 22, 1999, his sons and daughter retained the copyright.
